I. General provisions

1. The Federal Agency for Tourism (Rosturizm) is a federal executive body that carries out the functions of providing public services, managing state property, as well as law enforcement functions in the field of tourism and tourism activities.

3. The Federal Tourism Agency is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties Russian Federation, regulatory legal acts of the Ministry economic development Russian Federation, as well as these Regulations.

4. The Federal Tourism Agency carries out its activities in cooperation with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, authorities local government, public associations and other organizations.

II. Authority

5. The Federal Tourism Agency exercises the following powers in the established field of activity:

5.2.1. establishes the procedure for the submission by tour operators, in respect of which the legislation of the Russian Federation does not provide for the mandatory publication of accounting (financial) reporting data at the end of the reporting year, a copy of the annual accounting (financial) reporting at the end of the reporting year to the Agency;

5.2.2. establishes and brings to the attention of tour operators operating in the field of outbound tourism, the conditions and formats for the submission by a tour operator operating in the field of outbound tourism, reporting (with the exception of accounting (financial) reporting), including in the form electronic documents, as well as control ratios of its indicators;

5.3. on the basis and in the manner established by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the Federal Tourism Agency carries out the following functions for managing state property and providing public services in the established field of activity:

5.3.1. implements priority areas of state regulation of tourism activities in the Russian Federation, creates and maintains a unified federal register of tour operators;

5.3.1.1. implements documents strategic planning in the field of tourism on issues falling within the jurisdiction of the Russian Federation in terms of the Agency’s jurisdiction;

5.3.1.2. carries out information support tourism, including assistance in the creation and operation of tourist information centers, navigation and orientation systems in the field of tourism;

5.3.1.3. creates and provides favorable conditions for the development of the tourism industry in the Russian Federation;

5.3.1.4. assists in organizing vocational training according to training programs for specialists in the field of tourism in accordance with the legislation of the Russian Federation;

5.3.1.6. implements a calendar plan of all-Russian and interregional events aimed at supporting priority areas tourism development, including the development of domestic tourism, inbound tourism, social tourism, children's tourism and amateur tourism;

5.3.1.7. assists in creating and ensuring favorable conditions for tourists (excursionists) to have unhindered access to tourism resources located in the territories of the constituent entities of the Russian Federation and communications, as well as in receiving medical, legal and other types of emergency assistance;

5.3.2. informs tour operators, travel agents and tourists in the prescribed manner about the threat to the safety of tourists in the country (place) of temporary stay;

5.3.3. organizes and conducts events to promote tourism products in the field of domestic tourism and inbound tourism in the domestic and global tourism markets;

5.3.4. carries out in accordance with the legislation of the Russian Federation and other regulatory legal acts on contract system in the field of procurement of goods, works, services to ensure state and municipal needs of procurement of goods, works, services in the established field of activity;

5.3.5. exercises, in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of the federal government body in the field of activity established by paragraph 1 of these Regulations, including property transferred federal government agencies and federal state unitary enterprises subordinate to the Agency;

5.3.6. carries out economic analysis activities of subordinate state unitary enterprises and approves economic indicators their activities, conducts inspections of financial and economic activities and the use of property complex in subordinate organizations;

5.3.7. carries out the functions of the state customer of federal target, scientific, technical and innovation programs and projects in the established field of activity;

5.3.8. interacts in the prescribed manner with government bodies of foreign states and international organizations, including representing, on behalf of the Government of the Russian Federation, the Ministry of Economic Development of the Russian Federation, the interests of the Russian Federation in international organizations in the established field of activity;

5.3.9. creates representative offices outside the Russian Federation in the field of tourism. The procedure for their creation, operation and liquidation is determined by the Government of the Russian Federation in accordance with international treaties of the Russian Federation;

5.3.10. organizes the reception of citizens, ensures timely and complete consideration of oral and written requests citizens, making decisions on them and sending responses to applicants within the period established by the legislation of the Russian Federation;

5.3.12. organizes and ensures mobilization preparation and mobilization of the Agency, as well as control and coordination of the activities of organizations under its jurisdiction for their mobilization preparation and mobilization;

5.3.16. performs other functions for the management of state property and the provision of public services in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation;

5.5. carries out the functions of the main manager and recipient of federal budget funds allocated for the maintenance of the Agency and the implementation of the functions assigned to it.

6. In order to exercise powers in the established field of activity, the Federal Tourism Agency has the right:

6.1. request and receive, in the prescribed manner, information necessary for making decisions on issues within the competence of the Agency;

6.2. give legal and individuals clarifications on issues within the competence of the Agency;

6.3. involve, in the prescribed manner, scientific and other organizations, scientists and specialists to study issues within the scope of the Agency’s activities;

6.5. establish, in accordance with the established procedure, print media for the publication of official announcements and other materials on issues within the competence of the Agency.

7. The Federal Tourism Agency does not have the right to exercise control and supervision functions in the established field of activity, except in cases established by decrees of the President of the Russian Federation and decrees of the Government of the Russian Federation.

The restrictions on the powers of the Agency established by the first paragraph of this clause do not apply to the powers of the head of the Agency to resolve personnel issues and issues of organizing the activities of the Agency, as well as to the powers to control activities in the Agency headed by him (his structural divisions).

III. Organization of activities

8. The Federal Tourism Agency is headed by a director appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Economic Development of the Russian Federation.

The head of the Federal Tourism Agency is personally responsible for the implementation of the powers assigned to the Agency and the implementation of state policy in the established field of activity.

The head of the Federal Agency for Tourism has deputies appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Economic Development of the Russian Federation.

The number of deputy heads of the Agency is established by the Government of the Russian Federation.

9. The structural divisions of the Federal Agency for Tourism are the departments for the main areas of activity of the Agency. The directorates include departments.

10. Head of the Federal Agency for Tourism:

10.2. submits to the Minister of Economic Development of the Russian Federation:

10.2.1. draft regulations on the Agency;

10.2.2. proposals on the maximum number and wage fund of employees of the Agency’s central office;

10.2.3. proposals for candidates for the positions of deputy heads of the Agency;

10.2.4. draft annual plan and forecast indicators of the Agency’s activities, as well as a report on their implementation;

10.2.5. proposals for nominations for state awards of the Russian Federation, Certificate of honor of the President of the Russian Federation, a Certificate of Honor from the Government of the Russian Federation, for encouragement in the form of a declaration of gratitude from the President of the Russian Federation, a declaration of gratitude from the Government of the Russian Federation, for awarding a departmental insignia of the Ministry of Economic Development of the Russian Federation, giving the right to confer the title "Veteran of Labor", to employees of the Agency, subordinate organizations, as well as other persons operating in the established field;

10.3. approves regulations on the structural divisions of the Agency;

10.4. appoints and dismisses employees of the Agency;

10.5. resolves, in accordance with the legislation of the Russian Federation on civil service, issues related to the passage of the federal civil service at the Agency;

10.6. approves the structure and staffing table the central apparatus of the Agency within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, as well as the estimate of costs for maintaining the central apparatus of the Agency within the limits of the appropriations approved for the corresponding period provided for in the federal budget;

10.7. submits proposals to the Ministry of Finance of the Russian Federation on the formation of a draft federal budget for the corresponding year in the established field of activity;

10.10. on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, issues orders on issues within the competence of the Agency, as well as on issues internal organization work of the Agency.

11. The costs of maintaining the central apparatus of the Federal Tourism Agency are financed from funds provided in the federal budget.

12. The Federal Agency for Tourism is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other seals, stamps and forms of the established form, as well as accounts opened in accordance with the legislation of the Russian Federation.

The Federal Tourism Agency has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry of Economic Development of the Russian Federation in agreement with the Heraldic Council under the President of the Russian Federation.

13. The location of the Federal Tourism Agency is Moscow.

The Federal Agency for Tourism (Rosturizm) is an authorized federal executive body that carries out the functions of implementing state policy, legal regulation, provision of public services and management of state property in the field of tourism. The management of the activities of Rostourism is carried out by the Government of the Russian Federation.

Before the adoption of a special regulatory legal act Rostourism carries out licensing of tour operator and travel agency activities, as well as activities for the sale of rights to club holidays.

Unified Federal Register of Tour Operators

The Federal Tourism Agency informs you that, in accordance with Art. 4.1. Federal Law dated November 24, 1996 No. 132-FZ “On the fundamentals of tourism activities in the Russian Federation” (hereinafter referred to as the Law on Tourism Activities), the implementation of tour operator activities on the territory of the Russian Federation is permitted by a legal entity, subject to compliance following conditions:

Availability financial security liability of the tour operator (a contract or contracts of civil liability insurance for failure to fulfill obligations under an agreement on the sale of a tourism product and (or) a bank guarantee or bank guarantees for the fulfillment of obligations under an agreement on the sale of a tourism product);

Compliance of persons occupying the positions of the head of the tour operator, his deputy, chief accountant, other official who is entrusted with maintaining accounting tour operator, the requirements established by part three of Article 4.1 of the Law on Tourism Activities;

Membership of the tour operator in the association of tour operators in the field of outbound tourism ;

Availability of a tour operator’s personal liability fund (in case of carrying out activities in the field of outbound tourism);

Availability of information about the tour operator in the Unified Federal Register of Tour Operators.

The requirements for financial security of the responsibility of the tour operator are determined by Chapter VII.I of the Law on Tourism Activities.

Financial security for the tour operator's liability is not required for:

an organization providing excursion services on the territory of the Russian Federation for no more than 24 consecutive hours;

state and municipal unitary enterprises, as well as state and municipal institutions carrying out activities to organize travel within the territory of the Russian Federation in order to solve social problems;

a tour operator operating in the field of outbound tourism and having a tour operator personal liability fund formed in accordance with Article 11.6 of the Law on Tourism Activities in the amount of at least seven percent of the total price of the tourism product in the field of outbound tourism for the previous year.

Please note that the implementation of tour operator activities by a person whose information is not in the unified federal register of tour operators entails the imposition of an administrative fine on officials in the amount of fifty thousand to one hundred thousand rubles or disqualification for a period of six months to one year; for legal entities - from five million to ten million rubles.
